Payment Details

• We will pay you 15% commission to you for any referral that leads to the purchase of any Money Toolkits product or training for the lifetime of the customer relationship between Money Toolkits and the referred customer. 
  PLEASE NOTE:  This offer is strictly limited to products developed by Money Toolkits and is calculated on the selling price of the product (not including tax and shipping).  These include the following:

  • Destiny MAGNET$ MP3 Download
  • “21 Ways to Save More Money” E-book
  • MAGNET Money Training
  • Winning Money Habits – Corporate Training
• Cash rewards are calculated on a quarterly basis and paid one calendar month after the end of the quarter.  We will forward a commissions report via email and will directly deposit the money straight into your nominated bank account. 
• Commissions will be paid as long as your referee is not already on our database (i.e. they have not already been referred by another Affiliate), then you are automatically listed as their “Affiliate” and any cash rewards that come from any purchases they make will come back to you.
• If the person you referred cancels their product or training and their money is refunded for any reason, no cash reward will be paid to you.
• You will not be paid a cash reward for your own purchases or of that from your immediate family.

Terms of Agreement

• The terms of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause.  You are only eligible to earn referral fees on sales occurring during the term.
• Money Toolkits may amend or terminate the Affiliate program, in part or in its entirety, at any time.  
• Money Toolkits reserves the right to withdraw any Affiliate from this program if they wilfully abuse the integrity of this program or if they have brought the name of Money Toolkits into disrepute or at its sole discretion.   

Modifications

• Money Toolkits reserves the right to make updates and changes to these terms and conditions at its discretion without notification.   Modifications may include, for example, changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. If any modification is unacceptable to you, your only recourse is to terminate this agreement.    Your continued participation in the program following our posting of a change notice of new agreement on our site will constitute binding acceptance of the change.
• Money Toolkits will apply every effort to keep its website current and operational. However, technical difficulties may arise from time to time, resulting in temporary service interruptions. Money Toolkits will not be held responsible for such interruptions and any subsequent loss of Affiliate commissions.

Limitation of Liability

1. We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages.  Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement.

 Independent Investigation:

1. You acknowledge that you have read this agreement and agree to all its Terms and Conditions.  You understand that we may at any time (directly or indirectly) solicit customer referrals on terms that may differ from those contained in this agreement or operate web sites that are similar to or compete with your website.  You have independently evaluated desirability of participating in the program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.

Miscellaneous:

1. This Agreement will be governed by the laws of Australia, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Queensland, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

 Spyware:

1. We will refuse all applications or signups from affiliates which we believe participate in spyware, adware or parasiteware techniques for driving traffic. We reserve the right to research and investigate affiliates and their activities and, at our own discretion, determine whether or not these practices are in place. Affiliates found in violation of this policy will be immediately terminated from the program and will forfeit all commissions.

Your Responsibilities

1. We ask you to act with integrity at all times when promoting Money Toolkits.
2. As you can appreciate, any materials we supply to you with are copyright protected and cannot be duplicated without express written permission from Money Toolkits. Anything created outside of these materials must be approved by us prior to use. This includes, but is not limited to newspaper ads, newsletters, e-mail promotions, websites, BLOGs, Forums, newsgroups and audio media. Violation of this will result in suspension of your Affiliate account. Persistent abuse will result in termination of our affiliate relationship.
3. Under no circumstances can affiliates register domain names using any of our associated brand names to market our services. Registering domain names with variants of Money Toolkit’s name or any of the product’s names or any related brand is a breach of Affiliate Program terms and conditions.
4. Any published material using our copyright material must CLEARLY show the nature of your relationship with the Money Toolkits businesses to be that of an independent Affiliate. Any attempt to “pass off” your website, business or yourself as representing Money Toolkits in any other capacity is a serious breach of Affiliate Program terms and conditions.

Please note that we actively monitor the search engines, community websites etc in order to vigorously protect our brands and enforce these terms and conditions.

Any breach of the program terms and conditions may result in the suspension of your Affiliate account with us. Persistent abuse or ongoing failure to correct a breach will result in termination of our Affiliate relationship.
